1. Acceptance of Terms

By accessing or using the AI Humanizer service, website, or browser extension ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Cookie Policy. If you disagree with any part of the terms or our cookie usage practices, you may not access the Service. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

By accepting these Terms, you also agree to our Cookie Policyand consent to our use of cookies and similar tracking technologies as described therein.

2. Service Description

The Service provides tools to analyze text content for potential AI generation ("AI Detection") and modify text content to appear more human-written ("Humanization"). The Service utilizes third-party AI models and APIs.

3. User Accounts

You may need to register for an account to access certain features, including subscription services. You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to provide accurate and complete information during registration and keep it updated. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Marketing Communications and Consent

During account registration, you may choose to subscribe to our marketing communications. This consent is optional and separate from your acceptance of these Terms of Service.

  • Marketing Consent: If you opt-in to marketing communications, we may send you promotional emails, product updates, and other marketing materials related to our Service. We record your consent preferences along with the timestamp and source for compliance purposes.
  • Withdrawal of Consent: You may withdraw your marketing consent at any time by clicking unsubscribe links in our emails or contacting our support team. Withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.
  • Compliance: Our consent collection and processing practices comply with applicable data protection laws. We maintain detailed records of consent as required by law.

5. User Content

You retain ownership of the text content you submit to the Service ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, transmit, and store your User Content solely for the purpose of providing and improving the Service. You are solely responsible for your User Content and the consequences of submitting it. You represent and warrant that you have all necessary rights to submit the User Content and that it does not violate any third-party rights or applicable laws. We do not monitor or pre-screen User Content but reserve the right to remove any content that violates these Terms or is otherwise objectionable.

6. Service Usage and Limitations

  • AI Output: The AI Detection and Humanization features rely on complex AI models. Outputs are provided on an "as is" and "as available" basis. We make no warranties or representations regarding the accuracy, reliability, completeness, or suitability of the AI-generated outputs. The determination of AI content and the quality of humanized text can be subjective and may vary. You agree to use the outputs at your own risk and are solely responsible for verifying their accuracy and appropriateness for your intended use.
  • Word Limits: Subscription plans may include limits on the number of words processed per month. Additional word usage may require separate purchases. We reserve the right to change limits and pricing.
  • Dependencies: The Service relies on third-party APIs (e.g., for AI processing and payment processing via Stripe). Availability and performance may be affected by these third parties, for which we are not responsible.

7. Subscriptions and Payments

  • Fees: Certain features require a paid subscription. Fees are billed in advance on a recurring basis (monthly or annually) as selected.
  • Billing: You must provide accurate billing information and authorize recurring charges via our third-party payment processor (Stripe).
  • Cancellations: You may cancel your subscription at any time via your account dashboard or by contacting support. Cancellations take effect at the end of the current billing cycle. No refunds are provided for partial subscription periods.
  • Price Changes: We reserve the right to change subscription fees upon reasonable notice.
  • Additional Word Purchases: Purchases of additional word packs are non-refundable.

8. Acceptable Use

You agree not to use the Service, nor submit User Content, for any of the following purposes or in any of the following manners:

  • Illegal Activities: Promoting, facilitating, or engaging in any illegal activity, or violating any applicable local, state, national, or international law or regulation.
  • Harmful Content: Submitting or generating content that is hateful, harassing, abusive, threatening, defamatory, obscene, pornographic, racially or ethnically offensive, or otherwise harmful or objectionable.
  • Infringement: Violating the intellectual property rights of others, including copyright, patent, trademark, trade secret, or other proprietary rights. This includes submitting content you do not have the right to use or modify.
  • Academic Dishonesty: Using the Service to misrepresent the authorship of academic work, including submitting humanized text as your own original writing for academic credit, plagiarism, or violating any academic integrity policies. You are solely responsible for ensuring your use complies with all applicable educational institution rules.
  • Misinformation and Deception: Creating or disseminating false, misleading, or deceptive information, including impersonating individuals or organizations, or generating content intended to manipulate or defraud.
  • High-Risk Activities: Using the Service in connection with activities where errors or failures could lead to death, personal injury, or severe physical or environmental damage (e.g., operating critical infrastructure, medical applications, legal or financial decision-making). The Service is not designed or intended for such uses.
  • Unauthorized Access/Interference: Attempting to gain unauthorized access to the Service, user accounts, or related systems/networks; interfering with or disrupting the integrity, security, or performance of the Service.
  • Code Extraction: Reverse-engineering, decompiling, disassembling, or otherwise attempting to discover the source code or underlying algorithms of the Service.
  • Abuse: Exceeding usage limits, imposing an unreasonable load on our infrastructure, or using automated systems (bots, scrapers) in a manner that disrupts the Service.
  • Circumvention: Using the Service to bypass security measures, content restrictions, or paywalls on other websites or services.

We reserve the right to investigate violations of this Acceptable Use policy and may suspend or terminate your access to the Service, remove User Content, and report activities to law enforcement authorities if appropriate, without prior notice.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of the Service Provider and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED; THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

11. Limitation of Liability

IN NO EVENT SHALL THE SERVICE PROVIDER, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI-GENERATED OUTPUTS; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. OUR MAXIMUM AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING SIX (6) MONTHS.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Service Provider and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account; b) a breach of these Terms, or c) User Content submitted by you.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law provisions.

15. General Terms

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements. Our failure to enforce any right or provision will not be considered a waiver of those rights. If any provision is held to be invalid or unenforceable, the remaining provisions will remain in effect.
